Who this applies to

This policy applies to everyone who uses CamVue: workspace owners, admins, members, and anyone using an account or credential on their behalf, including anything that uploads with a workspace FTP login. It is part of our Terms of Service. If you break it, we may take action as described below.

Recording and footage

You must not upload, store, or process footage that:

  • was recorded illegally, including in restrooms, locker rooms, changing rooms, or any other place where people have a reasonable expectation of privacy and where recording is unlawful;
  • contains audio or conversations that were recorded without the consent the law requires. Several states require every party to a conversation to consent. If you are not sure, turn off camera audio before upload. We do not review uploads for consent;
  • you do not have the right to upload, store, and compress under the Terms;
  • shows child sexual abuse material (CSAM) or sexual content involving minors. We prohibit this absolutely. If we have actual knowledge of it, we report it to the National Center for Missing & Exploited Children (NCMEC) as the law requires, and we preserve it and related information as the law requires, despite any other deletion term. We may suspend a workspace immediately and without notice;
  • is used to stalk, harass, threaten, or unlawfully surveil any person; or
  • contains data CamVue is not for: protected health information we would hold under HIPAA, payment card data, criminal justice information that requires a CJIS agreement, education records you treat as FERPA records, or export-controlled or classified material.

You must also follow the laws that apply to your recordings, such as signage and notice rules, consent laws, and workplace monitoring rules. Footage must have been recorded in the United States.

Identifying people and automated decisions

You must not use CamVue, or ask us to use it, to identify or look for a person by their face, voice, gait, or body, or to create faceprints, voiceprints, or other biometric templates from footage. CamVue does not offer facial recognition, speaker identification, or identity matching. You must not upload footage for that purpose.

You must not use CamVue as a consumer reporting agency, or to make decisions about a person’s employment, housing, credit, insurance, or similar eligibility that are covered by consumer reporting laws.

Security and abuse of the service

You must not:

  • upload malware, or anything designed to damage, disrupt, or gain unauthorized access to the service, our systems, or other people’s systems;
  • try to access another customer’s workspace, data, or accounts, or probe, scan, or test the service’s security without our written permission;
  • overload or interfere with the service, or use automated means to access it in a way that harms its performance, other than the interfaces we provide to you, including FTP, FTPS, and SFTP uploads;
  • share or sell credentials, including FTP logins, or let people outside your organization use your accounts;
  • use the service to send spam, phishing, or deceptive messages;
  • upload material that infringes someone else’s copyright. We end the accounts of repeat infringers in appropriate circumstances; or
  • break the law, use CamVue for a person or place that is barred under sanctions or export laws, or help others to do so.

Our service and fair use

You must not:

  • reverse engineer, decompile, or try to extract the source code of the service, except as the law allows;
  • copy, resell, sublicense, or provide the service to others as a service of your own, unless we have agreed in writing;
  • remove or hide notices about ownership or origin in the service; or
  • use the service to build a competing product.

Billing limits

Cameras and NVR channels detected in your uploads are added and billed automatically, as the Terms describe. You must not circumvent per-camera billing. For example, do not split one camera’s footage across several cameras, mislabel a camera, or use other means to pay less than the Terms require. A recorder that is set up by mistake, such as one that sends the same footage twice, is not a violation by itself. We will tell you and ask you to fix it before we treat it as one.

Reporting and enforcement

If we believe someone has broken this policy, we may investigate, remove or disable access to content, suspend or end access to a user or workspace, and report the activity to the authorities. Where practical, we will tell you first and give you a chance to fix the problem. We may act immediately, without notice, when needed to stop serious harm, such as illegal content or a security threat. Except for CSAM and content the law requires us not to return, we generally disable access rather than delete, and we tell the workspace owner, unless a court or the law tells us otherwise. Footage that is deleted, whether at the end of retention, after termination, or by you, cannot be recovered.

To report a violation or abuse, email legal@camvue.net. Please include enough detail for us to look into it. Copyright complaints go to our designated agent, as the Terms describe.

Changes

We may update this policy. Material changes will be handled as described in the Terms. Questions? Email legal@camvue.net.
